>> happening now- firefighers battle a two- alarm fire at a one-story building in dowtown oakland. the building is located inth street at around 6:30 this morning. no injuries have been reported. our top story this morning. new details are emerging about the shooting at los angeles international airport. officials say the suspected gunman, 23-year-old paul ciancia , shot a t-s-a officer at point blank range. he then walked away, but returned moments later to shoot him again. kyung lah explains how the >> reporter: investigators are still piecing together their timeline of what happened inside terminal 3 they don't know every step of paul ciancia's path thru the terminal >> "but here's what they do know. a roommate dropped him off at the airport. he entered at about 9:20 in the morning one of these entrances at terminal 3." according to pictures like this one as well as surveillance video, the gun was a 223 caliber assault rifle, which ciancia concealed in a bag. >> "he then approached tsa officer gerardo hernandez

here who was standing there where those flowers are -- this is a prescreening area and shot him point blank, multiple times in the chest. he then got on this escalator." >> "the defendant is to then alleged to have begun walking away from the wounded tsa officer, going up escalator and then coming back down that escalator, to return and shoot the wounded officer again." >> reporter: "at the top of the escalator is the security checkpoint. at some point, he wounded two additional t-s-a officers and one passenger. this is the other side of the security checkpoint from here the gunman made his way deep into terminal 3. cell phone video captured the chaos as he neared the passenger gates." >> "people were running and getting knocked down. there was luggage everywhere. mayhem is the best way to describe it." >> reporter: we're speeding up this video so you can see his path as he wound through the terminal making his way to the gate area.

ciancia had five loaded magazines a host of unspent ammo enough, says the mayor of los angeles, to kill everyone in this terminal. it ended around here when los angeles airport police shot the gunman, a handwritten note was found on him. >> "we found a statement where he made a conscious decision to kill multiple tsa employees. he addressed them at one point in the letter and stated that he wanted to quote: 'instill fear in their traitorous minds.'" >> reporter: as the fbi works out the details of this murderous path the t-s- a is also asking how is it that in the post 9-11 era did a gunman could make it this close to an american passenger plane. >> "obviously this gives us great concern. so we'll look at what our policies are but it's all done in cooperation with each airport police agency and how we go about providing for the best possible

security." >> reporter: because on this day at america's third busiest airport it failed to prevent one man with a gun from doing this. kyung lah, cnn, los angeles. >> we are learning more about the victim of the shooting. 39-year-old gerardo hernandez. as loved ones grieve the death of the t-s-a officer. kron 4's mike pelton reports live from the newsroom with more on hernandez. and where the investigation goes from here. mike? >> 39-year-old gerardo hernandez is the first t-s- a official to die in the line of duty in the agency's 12-year history. and he would have celebrated his 40th birthday just next week. instead.family members are mourning his death. his widow.spoke for the giving details about the man she married on valentines day in 1998. hernandez.born in el salvador.is the youngest of four boys and moved to the united states at 15 years old. he joined the t-s-a in 2010 and his widow says he loved interacting with the

passengers at l-a-x. right up until friday when authorities say he was gunned down.hernandez leaves behind two children. >> he was a great man who always showed his love for our family. he was always there to help people in need and make people laugh with his wonderful sense of humor. he was a wonderful husband, father, brother, son and friend. >> reporter: as for the suspect.23-year-old paul ciancia. authorities say he was unrespnsive after airport police shot him. while authorities are still working to understand the motive behind the shooting. they have charged ciancia with two felonies - murder of a federal officer and commission of violence in an international airport. if convicted. he could face life in prison or, possibly, the death penalty. live in the newsroom, mike pelton, kron 4 news. >> bart and its unions are getting closer to finalizing a new labor contract. the two largest unions voted to ratify the contract

offer that ended the worker strike last month. the contract gives unions a 15 percent raise over four years.as well as improved safety enhancements like bullet-proof glass for station agent booths. bart management says the contract also lets them update technology without always needing union approval. here's reaction on the vote from both management and union officials. >> on want to think our members for the think-our members for these issues that are important i want to thank. --. >> the hard working employes will see a wage increase and of course the rapid increase in technology and equipment. that is something that we read not able to. will help bart implement everything from wireless handheld devices to the simple use of email istead of hand-written notes. going forward.the contract

happening now- the funeral for a nevada teacher -- gunned down by a student -- will be held later today. family and friends gathered yesterday -- to pay their respects to master sergeant michael landsberry. police say he died trying to intervene in last month's

shooting at sparks middle school. those who attended saturday's viewing say landsberry was more than a teacher. landsberry was a member of the nevada air national guard and a marine. his funeral is scheduled for three this afternoon. a new anti-smoking law is in effect in walnut creek. and, breaking the law could cost violators fines ranging from 100 to 500-dollars. but as kron four's philippe djegal explains. one city councilman is fighting to have the ban repealed. but the mayor of walnut creek doesn't agree. mayor cindy silva says despite what councilman wedel just told us. trying to repeal the smoking index of stories... councilman justin wedel says he's filed paperwork with the walnut creek city attorney to create an initiative. which would repeal the city's new second-hand smoking ordinance... and, create a new one with similar restrictions... only in his version, wedel says the city would be prohibited from banning smoking on private property. everywhere else he says would remain smoke free. wedel says the city's ban is unconstitutional... saying the council's four to one vote on the issue, favoring the ban, represents most of the city. wedel says he hopes to have his initiative on a 20- 14 ballot. but despite what wedel mayor silva says election or

special election... putting the initiative on a ballot will ultimately cost taxpayers. >> he believes that this ordinance could be unconstitutional so he has filed paper work with the attorney to create an initiative and also collecting signatures. >> to me it is all about private property rights. weather or not the city council has the right to legislate what happens on private property. i think that the majority. >> they need to collect 4200 signatures to put on a ballot. it would n cost taxpayers any thing. >> aid would be a special election and would not cost them. in walnut creek, philippe". cost probably 100,000." mayor silva goes on to say that she disagrees with councilman wedel's claim that the smoking ordinance

all lanes of westbound highway 5-80 in richmond are open after a deadly crash saturday night. a male pedestrian was struck and and killed around 9:50 saturday night. the man was struck when he apparently ran across the lanes of traffic. police say it happened near harbor way.but did not give further details about the crash. one person was also killed after driving a reported stolen car goes off a cliff near stinson beach. police say the car was reported stolen out of vallejo. c - h -p says they then received reports of a car that went off the road south of rocky point road around 4 p -m saturday. officers found a red honda accord around 200 - feet down the cliff. the driver's body had to be removed by helicopter due to the steep terrain. authorities are still trying to identify the driver. some parents in rancho cordova are fighting an elementary school policy that makes their children "freeze" at the end of recess and assume what parents call a "victimizing" position. siemny chhuon has the story. the two mothers also say they think a lot of parent's don't even know their kids are being asked to freeze at school. they are hoping this brings more awareness to what's being done at their kids schools. the application page of the troubled health insurance website is offline until 9 this morning the health and human services deartment says a technology team will be working with healthcare-dot- gov. this is making it so people won't be able to apply or enroll through the site. the federal website locked up on october first, the day it went live, and has had it's share of troubles ever since. the government says people can apply for coverage through the health marketplace call center. the administration has said it's aiming to have heathcare-dot-gov humming along by the end of the month. e-bay is apologizing this morning after apparent holocaust memorabilia was being offered for sale. m ndy wee oid od 40-tsand-e-ba st hareve 3itse

everyone on the floor now. >> reporter: federal prosecutors are now filing criminal charges against 23- year-old paul anthony ciancia. he is accused of opening fire with an assault rifle inside lax's terminal 3 killing 39- year-old tsa officer gerardo hernandez and wounding several others. he fired multiple rounds at point blank range at the tsa officer. hernandez's wife spoke briefly to reporters: gerardo would have been 40 next week. i am truly devastated. >> reporter: a man who came face to face with the gunman says the suspect seemed to be looking for tsa employees. . >> the shooter just calmly walking down the corridor. he had his gun and looked at me and said tsa? and i just shook my head, and he kept going. >> reporter: eventually, the fbi says law enforcement
